Our deliveries and other services to companies, legal entities under public law and special funds under public law are subject exclusively to the following terms and conditions.

§1 Scope of application

Cooperation with EDV-Beratung Lang shall be governed exclusively by the following General Terms and Conditions of EDV-Beratung Lang, Schumannstr.
38, 71732 Tamm, Germany (telephone: +49 (0) 71 41 / 91 14 26 – 0, e-mail: info@edv-lang.net).
You can download the terms and conditions to your computer and/or print them out.
Any provisions deviating from these terms and conditions shall only apply if they have been confirmed by us in writing.

§2 Conclusion of contract

The Customer shall be bound by its offer/order for 4 weeks from receipt by EDV-Beratung Lang.
A contract shall only come into effect once the order has been accepted by EDV-Beratung Lang.
In the case of orders placed via the Internet, confirmation of acceptance shall be sent by e-mail.
However, EDV-Beratung Lang reserves the right to reject an order within 14 days of receipt.

§3 Right of withdrawal and right of return

If a project is revoked by the client, EDV-Beratung Lang reserves the right to charge the client for any costs incurred as a result.
The client undertakes to pay these costs upon confirmation of our offer.

§4 Delivery

Packaging and transportation costs will be noted separately on the customer’s invoice.

§5 Due date and payment

Prices: The prices are quoted in euros, strictly net, excluding VAT (currently 19%), plus shipping, packaging and transportation costs plus the currently applicable VAT, unless otherwise agreed.
EDV-Beratung Lang reserves the right to make market-related price adjustments.

Payment: The entire outstanding invoice amount must be paid within 14 days of receipt of the invoice.
If payment is not made on time, the client shall be in default without a reminder.
EDV-Beratung Lang reserves the right to charge an additional 1.97% interest (effective annual interest rate maximum 6.97% – as of January 01, 2003).

§6 Retention of title

Until the customer has paid 100% of the invoices to EDV-Beratung Lang, we shall retain title to our deliveries.
The customer may not dispose of these reserved goods.

§7 Claims for defects

Obvious defects must be reported in writing within 2 weeks of delivery of the goods.
We can no longer accept late notifications.
In order to ensure that claims for defects are processed as quickly as possible, the customer should send in the device in question with as precise a description of the defect as possible, a copy of the invoice and in the original packaging.
Before returning the defective goods, the customer must make a data backup at his own expense.
No liability can be accepted for loss of data.

§8 Compensation

If the Client breaches the law or contractual agreements, EDV-Beratung Lang may suspend or restrict its services without prior warning and without compensation until the lawful situation has been restored.
In serious cases or in the event of recurrence, the contract shall be terminated without notice.
In any case, the contractually agreed claims shall remain owed and compensation shall be claimed for any damages and expenses incurred.
EDV-Beratung Lang reserves the right to initiate civil and criminal proceedings.

§9 Data protection / credit check

We are entitled to process the data about the customer contained in the terms and conditions or in connection with them, regardless of whether they originate from the customer himself or from third parties, in accordance with the Federal Data Protection Act.
This notice replaces the notification in accordance with the Federal Data Protection Act that personal data about the customer is stored and processed by means of EDP.

§10 Handling of customer data

When handling customer data, EDV-Beratung Lang complies with the applicable legislation, in particular telecommunications and data protection law.
Only data that is necessary for the provision of the service is stored and processed.

§11 Applicable law

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
